In these terms and conditions, “we” “us” and “our” refers to Class Education Pty. Ltd.- trading name of Class Coach.  Your access to and use of all information on this website including purchase of our service/s is provided subject to the following terms and conditions.  The information is intended for residents of Australia only.

We reserve the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended.  We therefore recommend that each time you access our website you read these terms and conditions.

Members

  1. In order to access the services provided on this website, you must become a member. You must complete registration by providing certain information as set out on our membership/registration page. Please refer to our Privacy Policy linked on our home page for information relating to our collection, storage and use of the details you provide on registration.
  2. Signing up to the website by any user under the age of 18 shall be deemed to be undertaken under the guidance of parent or guardian and the website shall not be responsible for any act of such user conducted otherwise under the guidance of the parent or legal guardian
  3. You agree to ensure that your registration details are true and accurate at all times and you undertake to update your registration details from time to time when they change.
  4. On registration, you will create your own Username and Password.
  5. We reserve the right to terminate your membership at any time if you breach these terms and conditions.
  6. Our services are intended to be used by members within Australia only.

Member Requirements

These Members terms govern the activities of members in relation to your use of the site and the services.

  1. When you use the site and services provided by Class Education, you must comply with any requirements directed by Class Education.
  2. To provide all service, internet and/or hardware, fees and costs associated with access and use of the services.
  3. Any problem concerning a technical issue regarding a member’s personal computer or internet service provider is not the responsibility of Class Education. You must use a headset and microphone (not loudspeakers) which must be plugged in and fully configured.
  4. To procure, maintain and pay for the latest available version of security software to protect against the transmission of viruses and other computer malware during access and use of the services provided by Class Education.
  5. To notify Class Education immediately should the student become incapacitated in any way and unable to attend the booked tutorial. Class Education can notify any tutor on your behalf
  6. Only contact the tutor through facilities provided on the site. Other means of communication is prohibited.
  7. Not to publish any abusive comments about a tutor or another student on the site or any other place including defamatory or derogatory comments.
  8. You agree that you will treat the tutors with respect and not use obscenities, make threats, or discuss matters other than those directly related to the subject of the tutorial session.
  9. You agree that you will not solicit any such information from any tutor, and agree that if any tutor ever discloses such information to you, asks you for any personal information or suggests any offline meeting or conversation, you will immediately report this to us.
  10. Agree that all sessions will be recorded for lookback of students, further training for tutors and be used for dispute resolutions if any conflict arises between you and Class Education.

Fees, Refunds and Cancellations

  1. Any payments received from the website by any user under the age of 18 shall be deemed to be undertaken under the guidance of parent or guardian and the website shall not be responsible for any act of such user conducted otherwise under the guidance of the parent or legal guardian.
  2. Payments made for services received may be made from your Account Funds. Placing credit into your Account Fund lets your student use these funds when required without your direct supervision. The student may only use what funds are available in the Account Fund. As with any purchase or booking on ClassCoach, you will receive an email when a booking is secured on your account.
  3. If requested – Account Funds that you have credited to your account may be refunded in full. Any Account Funds added as bonus or good will by Class Education will not be refunded.
  4. For the security of your financial details, all payments are made through Stripe. All payments made through the website will come up as “ClassCoach Pty Ltd” on your financial statements.
  5. You agree to pay the fees, in such amount and for such billing frequency as specified during registration, in full prior to any obligation of Class Education to perform under this Agreement. You further agree that, upon registering for the services through the Site, you authorise Class Education to charge your method of payment (e.g. credit card) for the fee on each anniversary of your registration date, based upon your billing frequency (e.g. monthly). Payment of the fees shall be in such amounts and at such times as set forth by Class Education through information provided to you and as authorised through the sign-up and registration process. Your account and access to the services provided via the Site may be suspended in the event of non-payment of applicable fees. You represent and warrant to Class Education that such payment information is accurate and that you are authorised to use the payment instrument. You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur.
  6. To cancel or pause your subscription Class Education requires 3 business days for both the Unlimited Tutoring Subscription and Starter Subscription notice before the next billing cycle, otherwise you will be billed for the following cycle.
  7. To cancel you must submit a cancellation request through the Account portal. We do not accept emails or phone calls for cancellations requests. Upon cancellation, you will continue to have access to the Class Education services through the end of the billing cycle, however all tutoring and services in progress will halt, regardless of status, once the billing period has ended.
    There are no refunds for partial subscription plans under any circumstance, including cancellations and unused time on a subscription. Upon cancellation you will have access to our service for the length of your current billing cycle.
    Class Education may change its fees from time to time with no advance notice required. Promotions, upgrades, and adjustments to existing plans are non-refundable.
  8. You, the customer are responsible to use Class Education after payment.

Tutoring

  1. All tutor sessions are booked by clients with the tutor via the bookings webpage. This service is a monthly subscription for services provided by Class Education.
  2. Mathematics tutoring is offered 5 days a week, Sunday to Thursday, 3pm to midnight (AEST). Tutors are on standby waiting for instant bookings. Class Education monitors the usage of this system and will staff according to demand. In some cases, you may not be able to book a time with a tutor when required.

Referrals

  1. Referral discount code: An existing Sponsor (the ‘Referring Sponsor’) can provide to new prospective sponsor(s) of new prospective students, a referral discount code. These referral discount code amount and conditions may vary based on promotions at that point in time and may only be available at certain times based on Class Education promotion strategy.
  2. At any time, Class Education may suspend or terminate your account at any time and for any reason without liability to Class Education.

Cancellations and No-Show Fees

  1. All tutoring appointments between Members and Class Education may be cancelled by either party at any time up to 2 hours of the tutoring session taking place.
  2. Mathematics tutoring bookings can be made on the day, when the tutoring session is required. As a result of the nature of this service, you are unable to cancel or reschedule these appointments once they are made.
  3. All no-show will result in the member being charged a fee of $25 on top of the existing subscription. This fee is to ensure that tutoring is available for others to use and members have the option of booking this time slot. Payment fees for no-shows need to be paid within 7 days or Class Education may cancel the subscription until the fees are paid.

Session Guarantee (Starter Subscription)

  1. If the student and/or parent is unhappy with how the session was conducted, Class Education is offering a 100% refund on that session.
  2. This guarantee is only available for the Starter Subscription tutoring sessions.
  3. All funds will be reimbursed into account funds.
  4. To be eligible for the refund, the parent and student must complete a survey form so Class Education can capture lessons learnt for further development of the platform and/ or the tutors.
  5. To start the money back process – please visit the Contact page, select Feedback on a session from the list of reasons and fill in as many details as you can about your experience and we’ll contact you shortly after.

Session Guarantee (Unlimited Tutoring Subscription)

  1. All members on the Unlimited Tutoring membership will receive at least one session per week that is booked in advanced during the school term. These sessions are booked by the Class Education team.
  2. Additional sessions can be booked through Book Tutoring on the webpage when logged in and are based on available time slots. No guarantee is made that there is an available time slot when booking these sessions as it is a first-come, first serve basis.
  3. Booking additional tutoring sessions on top of your weekly session can only be booked 1 week in advance.
  4. Fair use to unlimited tutoring applies. Fair use is determined by the Class Education team and may result in excess appointments being cancelled to allow other members to make use of the unlimited service.

Our Website Services

  1. All prices are in Australian Dollars (AUD) and are inclusive of GST. We endeavour to ensure that our price list is current.  Our price list can be accessed from our home page and we reserve the right to amend our prices at any time.  If you have placed an order, we undertake to fulfil your order at the price listed at the time you ordered.

Site Access

  1. When you visit our website, we give you a limited licence to access and use our information for personal use.
  2. You are permitted to download a copy of the information on this website to your computer for your personal use only provided that you do not delete or change any copyright symbol, trade mark or other proprietary notice. Your use of our content in any other way infringes our intellectual property rights.
  3. Except as permitted under the Copyright Act 1968 (Cth), you are not permitted to copy, reproduce, republish, distribute or display any of the information on this website without our prior written permission.
  4. The licence to access and use the information on our website does not include the right to use any data mining robots or other extraction tools. The licence also does not permit you to metatag or mirror our website without our prior written permission. We reserve the right to serve you with notice if we become aware of your metatag or mirroring of our website.

  1. This website may from time to time contain hyperlinks to other websites. Such links are provided for convenience only and we take no responsibility for the content and maintenance of or privacy compliance by any linked website.  Any hyperlink on our website to another website does not imply our endorsement, support, or sponsorship of the operator of that website nor of the information and/or products which they provide.
  2. Linking our website is not permitted. We reserve the right to serve you with notice if we become aware of such linking.

Intellectual Property Rights

  1. The copyright to all content on this website including applets, graphics, images, layouts and text belongs to us or we have a licence to use those materials.
  2. All trade marks, brands and logos generally identified either with the symbols TM or ® which are used on this website are either owned by us or we have a licence to use them. Your access to our website does not license you to use those marks in any commercial way without our prior written permission.
  3. Any comment, feedback, idea or suggestion (called “Comments”) which you provide to us through this website becomes our property. If in future we use your Comments in promoting our website or in any other way, we will not be liable for any similarities which may appear from such use.  Furthermore, you agree that we are entitled to use your Comments for any commercial or non-commercial purpose without compensation to you or to any other person who has transmitted your Comments.
  4. If you provide us with Comments, you acknowledge that you are responsible for the content of such material including its legality, originality and copyright.

Disclaimers

  1. Whilst we take all due care in providing our services, we do not provide any warranty either express or implied including without limitation warranties of merchantability or fitness for a particular purpose.
  2. To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded.
  3. We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.

Statutory Guarantees and Warranties to Consumers

  1. Schedule 2 of the Competition and Consumer Act 2010 (“C&C Act”) defines a consumer. Under the C&C Act we are a supplier of either goods or services or both to you, and as a consumer the C&C Act gives you statutory guarantees.  Attached to the Standard Terms and Conditions are:-
    1. Schedule 2 of the C&C Act; and
    2. those statutory guarantees, all of which are given by us to you if you are a consumer.
  2. If you are a consumer within the meaning of Schedule 2 of the C&C Act of our goods or services then we give you a warranty that at the time of supply of those goods or services to you, if they are defective then:-
    1. We will repair or replace the goods or any part of them that is defective; or
    2. Provide again or rectify any services or part of them that are defective; or
    3. Wholly or partly recompense you if they are defective.
  3. As a consumer under the C&C Act you may be entitled to receive from us notices under Schedule 2 section 103 of the C&C Act. In that regard:-
    1. If you are a consumer within the meaning of Schedule 2 of the C&C Act and the goods or services we are providing relate to the repair of consumer goods then we will give you any notice which we are obliged to give you under Schedule 2 section 103 of the C&C Act.
    2. If we are a repairer of goods capable of retaining user-generated data then we hereby give you notice that the repair of those goods may result in the loss of the data.
    3. If we are a repairer and our practice is to supply refurbished goods as an alternative to repairing your defective goods or to use refurbished parts in the repair, then we give you notice that the goods presented by you to us for repair may be replaced by refurbished goods of the same type rather than being repaired. We also give you notice that we may use in the repair of your goods, refurbished parts.

Limitation of Liability

  1. If you are not a consumer within the meaning of Schedule 2 of the C&C Act then this clause applies to you. If you are a consumer within the meaning of the C&C Act then this clause has no effect whatsoever to in any way limit our liability or your rights.  If you are not a consumer:-
    1. To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the services again or payment of the costs of having those services supplied again.
    2. We accept no liability for any loss whatsoever including consequential loss suffered by you arising from services we have supplied.
    3. We do not accept liability for anything contained in the post of a user or in any form of communication which originates with a user and not with Us.
    4. We do not participate in any way in the transactions between our users.

Indemnity

  1. By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.

Jurisdiction

  1. These terms and conditions are to be governed by and construed in accordance with the laws of NSW and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in NSW and you agree to submit to the jurisdiction of those Courts.
  2. If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.

Privacy

  1. We undertake to take all due care with any information which you may provide to us when accessing our website. However we do not warrant and cannot ensure the security of any information which you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
  2. Our compliance with privacy legislation is set out in our separate Privacy Policy which may be accessed from our home page.

Child Protection

Class Education uses an international supplier for all tutoring services. Class Education takes children protection extremely seriously and has created measures to ensure the safety of both students and tutors. Due to each Australian state laws varying and no state being able to cover international child protection, Class Education has a very strict child protection policy and procedures to ensure the safety of all Australian children in an online environment.

First Session Free Standard Terms and Conditions

  1. First Session Free refers to a single 1 hour session with a Class Coach online tutor.
  2. First Session Free is redeemable for 1 x 1 hour online tutoring session with Class Education ACN 630 539 758
  3. The First Session Free is not transferable or exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the offer.
  4. Class Education reserves the right to modify, suspend or terminate The First Session Free offer and codes at anytime without notice.
  5. Customers must enter the supplied education code to redeem their First Session Free.
  6. Customers must register with ClassCoach to redeem their First Session Free.
  7. First Session Free session’s must be booked in advance and are subject to session availability.
